The debate intensified after the SII enabled foreign online gambling platforms to declare and pay IVA in Chile
Chile’s online gambling market is expanding faster than the law built to control it. That gap is now forcing regulators, tax authorities, courts, operators and consumers to deal with a digital market that remains legally unresolved.
The debate intensified in June 2026, when the Servicio de Impuestos Internos, SII, issued Resolution Ex. No. 69. The measure created a system for foreign online betting, games of chance, casino and similar digital platforms to declare and pay IVA on services supplied to users in Chile.
The decision opened a new front in the discussion. Chile’s wider online betting regulation bill remains pending in the Senate, and key issues are still unresolved. These include licensing, enforcement, minor protection, payment traceability and controls over unauthorised platforms.
The SII has stressed that the measure is tax-related. It aims to improve control over digital services supplied from abroad. It does not, by itself, authorise online betting platforms to operate under a sector licence.
That distinction matters. Paying taxes is not the same as holding a gambling licence.
For consumers, however, the difference can be hard to understand. A platform may advertise, accept Chilean payment methods or appear in search results, but that does not necessarily mean it has a consolidated local authorisation.
Chile’s online casino growth has been driven by a simple mix of factors: mobile access, digital payments, intensive advertising and 24-hour availability. Unlike land-based casinos, users do not need to travel to a venue or enter a visible gaming environment.
That ease of access helps explain the speed of expansion.
The Superintendencia de Casinos de Juego, SCJ, continues to focus on the authorised land-based casino sector. Its institutional role is tied to regulating and supervising casinos under responsible gaming, security and transparency standards.
Digital consumption now moves on a different scale. Platforms can operate from abroad, target local users, process payments and promote their brands without a structure equivalent to that required of regulated land-based operators.
The SCJ has repeatedly stated that, in Chile, games of chance are illegal as a general rule unless a special law authorises them. Existing authorised verticals include Polla Chilena de Beneficencia, Lotería de Concepción, horseracing and casinos regulated under the current casino framework.
The regulator also says the commercial operation of online betting platforms is illegal while there is no specific law permitting and regulating that activity.
That is the gap the online betting bill is intended to address.
The bill, identified as Boletín No. 14.838-03, seeks to create a framework so the state can identify who operates in Chile, under which conditions and with what obligations. Government presentations to the Senate have argued that platforms currently operating in Chile do so illegally and that regulation would strengthen enforcement, traceability and the prevention of related crimes.
Several central measures have been discussed. These include a requirement to obtain authorisation to operate in Chile, the incorporation of local companies with an exclusive corporate purpose, user and beneficial-owner identification rules, protection measures for children and adolescents, restrictions on advertising by unauthorised platforms, and the creation of a National Responsible Betting Policy.
The proposed framework also includes powers linked to blocking, payment control and sanctions against illegal gambling.
The purpose is to move from a dispersed market to one with identifiable responsibilities. A regulated platform would need to meet technical, financial and advertising requirements and answer to Chilean authorities.
The tax issue has complicated the policy debate because it creates a visible interaction between the state and foreign platforms before the sector is fully licensed.
Supporters of the SII approach may see it as a way to reduce tax leakage from offshore digital activity. Critics may argue that the measure risks confusing consumers by making illegal or unauthorised operators appear more formal.
The Senate’s Economy Committee examined the issue after public concern over the resolution. The debate centred on how the tax mechanism fits with the unresolved legal status of online betting.
This is a difficult policy balance. A tax authority can seek payment from foreign digital service providers without becoming the gambling regulator. But the public may still interpret tax compliance as a sign of legitimacy.
That is why consumer information is important during the transition.
Users should not assume that a website is safe simply because it appears in search engines, sponsors content, advertises heavily or allows payments in Chilean pesos.
Before creating an account, players should review basic risk signals. These include licence information, responsible gaming tools, age verification, withdrawal conditions, complaint procedures, bonus terms, payment methods and the authority that could intervene if something goes wrong.
The practical approach is preventive. A good interface or visible promotions do not replace clear rules, accountable operators and enforceable player protection.
Chile still has time to organise the growth of online casinos through a balanced framework. But the longer the market expands without full regulation, the harder it becomes to separate tax compliance, consumer perception and legal authorisation.
The challenge for the state is to protect users without pushing activity deeper into informality. That means coordination between tax authorities, gambling regulators, financial channels, consumer agencies and lawmakers.
For platforms, the message is becoming clearer. Stable operation in Chile will depend on meeting local standards, not only on being available online.
The market is already active. The next step is deciding how quickly Chile can turn that activity into a licensed, supervised and transparent sector.
